These Terms & Conditions ("Terms") govern your access to and use of the FoxStays Docks website, platform, and related services (collectively, the "Services"). By accessing or using the Services, listing a dock, or booking dockage, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

FoxStays Docks is operated by FoxStays Docks LLC ("FoxStays," "we," "us," or "our"). We may update these Terms from time to time, and your continued use of the Services after any change constitutes acceptance of the revised Terms.

FoxStays Docks operates a managed network that connects dock owners ("Owners") with boat and yacht owners seeking dockage ("Renters"). We facilitate listings, communication, scheduling, and support between the two parties.

Unless expressly stated otherwise in a separate written agreement, FoxStays acts as a facilitator and manager of dock arrangements. We are not a party to the marine lease or license entered into between an Owner and a Renter, and we do not own or operate the docks listed on the platform.

You must be at least 18 years old and able to form a legally binding contract to use the Services. By using the Services, you represent that the information you provide is accurate and that you have the authority to list a dock (if an Owner) or to operate and dock the vessel you book (if a Renter).

Owners are responsible for the accuracy of their listings, including dock dimensions, depth, shore power, accessibility, and availability. Renters are responsible for confirming that a dock suits their vessel before booking.

Rates, fees, and availability are shown at the time of booking. A dockage arrangement is confirmed only when FoxStays or the Owner accepts the request and any required payment is processed. Applicable taxes and service fees may apply.

Cancellation and refund terms depend on the specific booking and any policy disclosed at the time of reservation. Where no specific policy is stated, cancellations are handled on a case-by-case basis. Refunds, where due, are returned to the original payment method.

FoxStays may cancel or relocate a booking if a dock becomes unavailable or unsafe, in which case we will work to provide a comparable alternative or a refund.

Boating involves inherent risks. Each party is responsible for maintaining appropriate insurance for its vessel, dock, and activities. You use the Services and any dock at your own risk.

To the fullest extent permitted by law, FoxStays is not liable for damage to vessels, docks, or property, or for personal injury, arising from the use of any dock arranged through the platform, except to the extent caused by our gross negligence or willful misconduct.

The Services, including text, graphics, logos, the FoxStays Docks name and brand, and software, are owned by or licensed to FoxStays and are protected by intellectual property laws. You may not copy, reproduce, or create derivative works without our prior written consent.

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any listing information is complete or accurate.

To the maximum extent permitted by law, FoxStays and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Services. Our aggregate liability for any claim relating to the Services will not exceed the amount of fees you paid to FoxStays in the six (6) months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless FoxStays and its representatives from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your listing or booking, your vessel or dock, or your breach of these Terms.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Broward County, Florida.

We may revise these Terms at any time by posting an updated version on this page and updating the "Last updated" date above. Material changes will take effect when posted, and your continued use of the Services constitutes acceptance of the revised Terms.
